Terms and Conditions.
- 1. The competition (Promotion) is conducted by Matchbox Franchising Pty Ltd (the Promoter), ABN 23 160 029 862, of 2A, 28 Riddell Pde, Elsternwick, VIC, 3185.
- 2. Entry is free and open to Australian residents, over 16 years of age, except employees (& their immediate families) of the Promoter & companies associated with the Promotion.
- 3. Information on prizes & how to enter form part of these Terms & Conditions. Entry to the Promotion constitutes acceptance of these Terms & Conditions.
- 4. The Promotion commences at 9:00am AEST on Thursday 1st October 2009 & concludes at 5:30pm AEST on Saturday 31st October 2009 (Promotional Period). Entries, votes and nominations received outside of the Promotion Period will not be eligible to win prizes with the Promotion.
- 5. To enter, entrants must:
- 5.1 register online at www.thesecretrecipe.com.au (the Website) during the Promotional Period and;
- 5.2 submit their 'Secret Recipe' entry including an (optional) image (Image) and/or;
- 5.3 vote for your favourite 'Secret Recipe' online (you may vote only once for any one recipe, including your own) and/or;
- 5.4 nominate someone you know to enter their 'Secret Recipe' by using the Nominate section of the Website
- 6. Enter a Recipe:
- 6.1 all entries are subject to administration approval by Matchbox head office before they will be made live on the Website
- 6.2 you may submit multiple 'Secret Recipe' entries, subject to administration approval
- 6.3 each valid entry will be evaluated against the judging criteria (Criteria) by the Promoter and campaign judge Poh Ling Yeow (Judge)
- 6.4 the Criteria will involve a combination of the following: story or history behind the recipe, recipe presentation (Image), appreciation of fresh food ingredients and an understanding of basic cooking principles
- 6.5 from all valid entries submitted during the Promotional Period, one entry will be judged as the competition winner (Main Prize Winner), winning the Main Prize consisting of a $20,000 kitchenware makeover
- 6.6 as part of each entry submission, entrants must certify that they have the right to distribute the submitted recipe entry and Image, to constitute a valid entry
- 6.7 the valid entry with the most online votes (Online Winner) from registered Website members will win a spot Prize (Online Prize) consisting of 1 x Circulon 4 Piece Cookware Set (valued at $694.80), 1 x Maxwell & Williams 40 Piece White Basics Dinnerset (valued at $79.95) and 1 x Maxwell & Williams 58 Piece Cutlery Set (valued at $340.00)
- 7. Vote for Recipes:
- 7.1 all valid entries made live on the Website will be subject to votes from registered Website members
- 7.2 registered Website members may vote for each valid live entry (including your own entries) only once each
- 7.3 each registered Website member that submits at least one vote for any valid entry will be eligible to win the Voter Prize
- 7.4 the winner of the Voter Prize will be chosen at random from the pool of registered Website members that have placed a vote(s) for valid entries
- 7.5 the Voter Prize consists of 1 x Circulon 2 Piece Cookware Set (valued at $374.90) and 1 x Maxwell & Williams 40 Piece Cutlery Set (valued at $225.00)
- 8. Nominate Someone:
- 8.1 registered members may nominate people to enter using the Nominate section of the Website
- 8.2 each registered Website member that nominates at least one person via a valid email address using the Nominate section of the Website will be eligible to win the Nominator Prize
- 8.3 the winner of the Nominator Prize will be chosen at random from the pool of registered Website members that have submitted at least one nomination to a valid email address
- 8.4 the Nominator Prize consists of 1 x Circulon 2 Piece Cookware Set (valued at $374.90) and 1 x Maxwell & Williams 40 Piece Cutlery Set (valued at $225.00)
- 9. The Main Prize $20,000 kitchenware makeover will consist of kitchenware and cookware products chosen by the Promoter, to the minimum recommended retail value of $20,000. The Promoter, at it's discretion, may include Matchbox Gift Card(s) as part of the prize value. Matchbox Gift Cards (Gift Cards) can be used for any product available in a Matchbox store, as chosen by the Main Prize Winner. Gift Cards are valid at any Matchbox store and can be used at interstate stores with no delivery costs. Gift cards are not transferable or redeemable for cash.
- 10. The Main Prize Winner and Online Winner will be determined and notified on Wednesday 4th November 2009.
- 11. The Voter & Nominator Prize Draws will be conducted at 3pm AEST at Matchbox Head Office, 2A, 28 Riddell Pde, Elsternwick, VIC, 3185, on Tuesday 3rd November 2009.
- 12. All Prize winners will be notified by phone & published on the Promoter's websites www.matchbox.com.au and www.thesecretrecipe.com.au
- 13. If any Prizes are unclaimed an 'unclaimed prize draw' will be conducted on Friday 27th November 2009 at Matchbox Head Office at 3pm.
- 14. The Promoter reserves the right to verify the validity of entries & disqualify ineligible entrants.
- 15. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.
- 16. This is a game of skill and chance plays no part in determining the Main Prize Winner and Online Winner.
- 17. The Promoter's decision is final & no correspondence will be entered into. The Promoter will not be responsible for any lost, late or misdirected entries.
- 18. Prizes are as specified & cannot be transferred, exchanged or redeemed for alternative items or cash. The Promoter accepts no responsibility for variation in prize values. Where a Prize is unavailable, the Promoter retains the right to substitute the Prize with a Prize of equal or greater value.
- 19. All Recipe Entries, including content, recipe story and submitted image become the property of the Promoter. By entering this Promotion, each entrant consents to the Promoter using the entrant's entry / recipe and photograph in future advertising or promotional materials at the Promoter's discretion, without any reference, payment or other compensation to the entrant.
- 20. All registered Website members consent to the information they submit being entered into the Matchbox Cooking Club database & that the Promoter may use this information in any media, for future promotional, marketing & publicity purposes without any reference or compensation to the entrant. The Promoter is bound by the Information Privacy Principles in the Information Privacy Act 2001 (Vic). All personal details of the entrants shall be stored and administered by the Promoter. A request to access/update/correct any information should be directed to the Promoter by calling 03 9528 5911 during business hours.
- 21. The Promoter & its associated companies will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or any personal injury suffered or sustained as a result of receiving, taking or using any Prize. By receiving, taking or using any Prize, each winning entrant is deemed to release the Promoter & its associated companies from any liability which cannot be excluded by law.
